A. Can the Lupon handle this case?

Answer each question about the dispute. This is a general guide, not legal advice. The Local Government Code (Sections 408 to 422) and the current DILG rules decide.

B. The steps and the deadlines
  1. File the complaintThe complainant tells the Punong Barangay (as Lupon Chairperson) about the dispute, by word or in writing. The Lupon Secretary records it in the docket.
  2. Summon the respondentThe next working day, issue a summons to the respondent and a notice to the complainant. The first meeting is set no later than 3 days after the complaint is received.
  3. Mediation by the Punong BarangayThe Punong Barangay tries to settle the dispute. Mediation lasts up to 15 days from the first meeting.
  4. Pangkat ng TagapagkasundoIf mediation fails, the Pangkat of three members is formed from the Lupon members. It has 15 days from its first meeting to settle the dispute, and it can extend by another 15 days.
  5. Amicable settlement or arbitration awardA settlement is written, signed by the parties and attested by the Punong Barangay or the Pangkat Chairperson. Each party has 10 days to repudiate it. After that it has the force of a final court judgment.
  6. Certificate to File ActionIf there is no settlement, the Lupon or Pangkat Secretary issues the certificate, attested by the Chairperson. Only then can the complainant take the case to court or another office.
  7. ExecutionThe Lupon can enforce a settlement within 6 months from the date of settlement. After that, the party must ask the city or municipal court.

Parties must appear in person, without a lawyer or representative. Minors and incompetents can be helped by a next-of-kin who is not a lawyer.
